style=\"mso-spacerun: yes;\">\u00a0 <\/span>As with the other articles in this series, the focus is on experts, but most of the principles apply to fact witnesses as well.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: center;\" align=\"center\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 14.0pt;\">Direct Examination<\/span><\/strong><\/p>\n<p class=\"MsoNormal\"><strong style=\"mso-bidi-font-weight: normal;\">Control by Counsel<\/strong><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Prep sessions with the witness should begin with a note from counsel regarding control.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>While avoiding the image of a puppet, as described in Part I, counsel must nevertheless control the structure of the examination and flow of information to the jury.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\"><a href=\"https:\/\/www.tunno.com\/wordpress\/wp-content\/uploads\/2013\/04\/Slide17.jpg\"><img decoding=\"async\" includes a series of closed-ended questions followed by open-ended questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The closed-ended questions are set-up questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Both question and answer are brief.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The questions are not leading, just short.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This puts the pressure on counsel, where it belongs, to structure the examination in a way that teaches the information at the proper pace, and according to the stepped learning and chunking principles explained in Part II.<span style=\"mso-spacerun: yes;\">\u00a0\u00a0 <\/span>Where the witness shines is more in response to the open-ended questions that elicit narrative responses.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The witness should understand, however, that the learning process for the jury, the learning of a \u201cchunk\u201d of information, if you will, involves the question and the answer, not the answer alone.<\/p>\n<p class=\"MsoNormal\"><strong style=\"mso-bidi-font-weight: normal;\">Shortest Possible Truthful Response<\/strong><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The witness should be made to understand that, at all times, the guiding principle of an effective answering technique is to provide the <strong style=\"mso-bidi-font-weight: normal;\">shortest possible truthful response<\/strong>.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This is especially true of cross, as you see later, but allows the direct examination attorney the control he or she needs.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It\u2019s a strategy without a down side.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If the witness\u2019s answer is too brief, and especially if it omits important information, the attorney will simply ask another question.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">The strategy is especially important during cross-examination.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>I teach witnesses that the longer they talk on cross-examination the closer their foot is getting to their mouth.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>I also liken the experience to that of a goalie in hockey or soccer.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It\u2019s not the goalie\u2019s job to score points, but to block shots.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Only if the opportunity presents itself for a wide-open shot at the opponent\u2019s goal is offense in order.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>That comes rarely in cross, but it does happen.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Making it happen is the goal of \u201cInviting the Open-Ended Question\u201d discussed later.<\/p>\n<p class=\"MsoNormal\"><strong style=\"mso-bidi-font-weight: normal;\">The Shoes of the Jurors<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">For the attorney, remembering that the question itself is integral to the learning process only works when the attorney \u201cwears the jurors\u2019 shoes,\u201d so to speak, and asks the questions the jurors would ask if they could.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>In Part I of this series, I mention that one of the problems with expert witnesses is the attorney, not the witness.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Specifically, the problem arises when the attorney gains so much expertise in the subject matter he or she becomes something of an expert.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>In trial, this can result in the attorney and witnesses communicating only with each other.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This is why it\u2019s smart to \u201cplay dumb.\u201d<\/p>\n<p class=\"MsoNormal\" style=\"text-align: center; text-indent: .5in;\" align=\"center\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 14.0pt;\">Cross-Examination<\/span><\/strong><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>For direct examination, the approach by counsel and witness outlined above, together with the teachings in Parts I and II of this series should be sufficient to produce a successful examination.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Cross-examination is another matter.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><strong style=\"mso-bidi-font-weight: normal;\">Here the witness must understand the most important skill is not speaking, but listening.<\/strong><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Witnesses understand the importance of listening when they also understand that cross-examination is an attempt by the opposing attorney to testify and to force the witness to concede (or to convince the jury of concessions) to that testimony.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Witnesses should understand that cross-examination questions aren\u2019t really questions so much as they are statements with an interrogatory phrase added to comply with courtroom procedures.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>I explain it to witnesses as an attempt to put words in their mouths.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As such, it behooves them to listen to those words.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>One of the teaching tools that seem to work is to sketch out the typical pattern of cross-examination questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Similar, in a sense, to direct examination, that pattern begins as a series of short questions designed to elicit agreement.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>While the cross-examining attorney would like affirmative responses to all the questions, it is particularly important in that first phase, the setup phase.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The questions (statements) in the setup phase are often undeniably true, leading to a series of agreements from the witness.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Using those agreements, opposing counsel then attempts to construct a conclusion that will seem to the jury to flow logically from the previous agreements.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>One of the biggest problems with expert witnesses is that they tend to be smart\u2014so smart that they think ahead of the attorney to what they think will be the conclusion.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>While they may be absolutely correct about the conclusion, their effort causes them to attempt to prevent the attorney from reaching that conclusion, the punch line, if you will.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>They do this by disagreeing, even arguing about the veracity or accuracy of the setup questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>In the vernacular of old western movies, they try to \u201chead them off at the pass.\u201d <span style=\"mso-spacerun: yes;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The not-so-bright witness presents a different problem.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He allows himself to be lulled into a pattern of affirmative responses to straightforward questions and doesn\u2019t hear the zinger at the end.<\/p>\n<h1 style=\"text-align: justify;\"><span style=\"font-size: 18px;\"><strong><span style=\"font-family: 'Times New Roman','serif';\">One Question at a Time<\/span><\/strong><\/span><\/h1>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>A key to teaching experts the skills necessary to be effective witnesses is to keep the list of \u201cdo\u2019s and don\u2019ts\u201d as short as possible.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>On the short list of \u201cdos\u201d is taking cross-exam questions one at a time, regardless of how intelligent or experienced the witness might be &#8211; one question at a time and one answer.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As counter-intuitive as it may seem to be, just answer the present question, don\u2019t anticipate the next one.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The logic of this will become apparent.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>While listening is clearly the most important skill, patience runs a close second.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As a result of analyzing questions and anticipating where a line of questioning is going (or should be going), experts often try to cut to the chase, or as I say, \u201chead them off at the pass.\u201d<\/p>\n<p class=\"MsoNormal\"><a href=\"https:\/\/www.tunno.com\/wordpress\/wp-content\/uploads\/2013\/04\/card-graphic1.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-258 aligncenter\" title=\"card graphic\" src=\"https:\/\/www.tunno.com\/wordpress\/wp-content\/uploads\/2013\/04\/card-graphic1.jpg\" alt=\"\" width=\"286\" height=\"214\" srcset=\"https:\/\/www.tunno.com\/wordpress\/wp-content\/uploads\/2013\/04\/card-graphic1.jpg 960w, https:\/\/www.tunno.com\/wordpress\/wp-content\/uploads\/2013\/04\/card-graphic1-300x225.jpg 300w\" sizes=\"(max-width: 286px) 100vw, 286px\" \/><\/a><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">I teach witnesses that cross-exam is much like a card game.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The cards are words and if the witness is patient, opposing counsel will eventually have to use the words that tell us what is in his hand.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As a reminder, the attorney is testifying more than he is questioning.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If he keeps the words to himself, he won\u2019t score any points.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Eventually, the attorney will have to show his hand and the witness will have the opportunity to disagree.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">Analyzing questions and anticipating a line of questioning often causes the witness to quibble with the setup questions \u2013 digging in his heels and disagreeing inappropriately.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This leads to juror impressions of lost objectivity and argumentativeness.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If the effect is severe enough, the cross-examining attorney never has to ask (and risk) the ultimate conclusion.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>With the witness having damaged his credibility, the attorney will have already won the battle and won\u2019t have to show his cards.<\/p>\n<h5><span style=\"font-size: 16px;\"><strong><span style=\"font-style: normal;\">Qualified Answers<\/span><\/strong><\/span><\/h5>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">With the goalie image in mind, instead of fighting with opposing counsel on those setup questions, I advise witnesses to offer qualified responses where necessary and, more importantly, truthful.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The qualifier should always precede the answer.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Using an example where a qualified agreement is appropriate, it could read as follows: <span style=\"mso-spacerun: yes;\">\u00a0<\/span>\u201cThat is generally true, yes,\u201d or \u201cIf by ____, you mean ______, then that would be true, yes,\u201d or, leaning more to the negative, \u201cOnly in certain circumstances would that be true.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The rationale for the qualified answer is simple.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Even though the cross-examining attorney is asking for (even demanding) a \u201cyes\u201d or \u201cno\u201d answer, the truthful response may be somewhere in between.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">What gives the witness the right to offer a qualified response where a \u201cyes\u201d or \u201cno\u201d was asked for?<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As I tell witnesses, they, not the attorneys, or sworn to tell the truth.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">This technique is discussed further in the section below, \u201cInviting the Open-Ended Question,\u201d where it becomes more of an offensive weapon.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Here it is offered simple as a method that allows the witness to answer the question truthfully, but leaving room for clarification later.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Though it may not come out until re-direct, a qualified answer, such as the examples above, may become the reason the witness can truthfully answer \u201cno\u201d to the ultimate conclusion.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The qualified answer also helps friendly counsel write his re-direct questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>\u201cDr. Phillips, under cross examination, you said opposing counsel\u2019s statement would only be true \u2018under certain circumstances.\u2019<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Please explain that to the jury.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Naturally, if those are not the circumstances, as the witness sees them, at hand, that leads to a new line of questioning.<\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 16px;\"><strong style=\"mso-bidi-font-weight: normal;\">The Power of the Pause<\/strong><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">How does the witness know when to offer a qualified answer?<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Only when he has listened very carefully to the question, all the way through, and has not formulated the answer until after the question and after adding a brief pause.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">All questions get the same pause, no matter how easy or straightforward.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This requires discipline, but when it comes to the pause, it is important to treat all questions the same.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If the witness has been listening intently, the brief pause (about a second) is all that is needed to answer the question.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>In effect, the witness is processing the following information; 1) \u201cDid I hear that question correctly?\u201d and 2) \u201cIf so, what is the answer?\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The pause also serves to allow friendly counsel the opportunity to object, if necessary.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">While the process is important for all questions, even the setups, it is vital when responding to the conclusion questions, which, as I mentioned above, are really more statements than questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It is easier, and common, for the attorney to slip in a loaded word or phrase, or even twist the statement from one end to the other so that it sounds like he\u2019s headed in one direction at the start, but ends up somewhere else.<\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 16px;\"><strong style=\"mso-bidi-font-weight: normal;\">Pace Control<\/strong><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Cross examination is difficult enough at any pace, but the witness needs to understand that opposing counsel knows where he is going.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He has a list of questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He wants the pace to be quick.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He wants the witness to answer quickly.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He will frequently cut off the end of an answer to quicken the pace and to make the witness feel he has to answer more quickly in order to get the answer in at all.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>A fast pace favors the attorney.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The pause, together with a slower, more deliberate delivery of the answer, slows the pace in favor of the witness.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>For the benefit of the witness, I compare it to a basketball game.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>One team likes to play at a fast pace, while the other likes to slow it down.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The problem for the fast team is that you have to possess the ball to determine the pace and the other team possesses it half the time.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>When the question has been asked, the witness controls the pace.<\/p>\n<h1><span style=\"font-size: 18px;\"><strong><span style=\"font-family: 'Times New Roman','serif';\">Don\u2019t Answer a Better Question Than Was Asked<\/span><\/strong><\/span><\/h1>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">Another result of experts analyzing questions is a tendency to reconstruct it in a way that makes sense.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This is doing the work of opposing counsel.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Consistent with the recommendation to answer one question at a time is the further recommendation to just answer the question asked.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If the question is so bad it can\u2019t be answered, then that is the answer.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The trade off for being the only one of the two people in the examination under oath to tell the truth is that you get to tell the truth.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>That is the job.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The job of the attorney is to ask questions that are unambiguous.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Make the attorney do that job.<\/p>\n<h3><strong><span style=\"font-size: 18px; font-family: 'Times New Roman','serif';\">Default Responses<\/span><\/strong><\/h3>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Default responses are a very simple tool to allow the witness to make sure of the answer before giving it.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>There are a wide variety of possible default answers, but they all mean about the same thing, the question needs to be repeated or rephrased.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The default response comes after that brief pause following the question.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If the witness is in doubt about the first question above, \u201cDid I hear that question correctly,\u201d the answer is automatically a default response.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>\u201cWould you please repeat the question\u201d is just one of many possible examples.<span style=\"mso-spacerun: yes;\">\u00a0\u00a0 <\/span>Another might be, \u201cIt depends on what you mean by _____.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As a cautionary note, this recommendation should not be interpreted to mean a Clinton-like response, &#8220;It depends upon what the meaning of the word &#8216;is&#8217; is.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>That would be argument, a condition these recommendations are intended to prevent.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The default response prevents the witness from answering bad questions out of a sense of obligation.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It also prevents long, awkward pauses that make the witness look dumfounded when, for example, he might be just trying to make sense of a bad question.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">Here again, the pause is key to the technique.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It trains the witness to listen to the question all the way to the end and not begin formulating the answer during the question.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>We know that many attorneys are skilled at flipping the question in midstream.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This technique, which is inseparable from the listening directive, gives the witness a better chance of catching those types of questions.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It also gives the witness another tool to control the pace, which is to slow it down slightly.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<h1><strong><span style=\"font-size: 18px; font-family: 'Times New Roman','serif';\">Tone Matters<\/span><\/strong><\/h1>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>In the case of those setup questions, when the attorney is right, he\u2019s right.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>I advise the witness to give it to him, but give it to him with that matter-of-fact tone.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The witness is saying \u201cyes,\u201d but effectively telling the jury nothing is happening, no points are being scored.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>When the hand is tipped and the conclusion comes out, then it\u2019s time to say \u201cno\u201d and to do so emphatically.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Emphasis is important.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>A limp \u201cno\u201d can sound just as much like an admission as a \u201cyes.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<h1><strong><span style=\"font-size: 18px; font-family: 'Times New Roman','serif';\">Inviting the Open-Ended Question<\/span><\/strong><\/h1>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>This is where defense can be turned into offense on cross examination.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>During the setup phase, the witness may hear statements to which he cannot entirely agree.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>This provides him with a few options, some of which are designed to make the glass half empty.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He can respond, for example, \u201cThat statement is only partly true.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Keeping in mind that the most important people in the courtroom are the jurors, we can ask ourselves, what would be the jurors\u2019 natural reaction to that answer?<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The obvious answer is that jurors would likely want the next question to be, \u201cWhich part isn\u2019t true?\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>That\u2019s not going to make opposing counsel\u2019s top 10 questions list.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The witness is inviting the open-ended question.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The above is a very subtle invitation.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If the witness chooses, the invitation can be more assertive.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>\u201cThat statement is only partly true, may I explain?\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The witness is staying out of argument, but is putting the attorney on the horns of a dilemma.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>He doesn\u2019t want to ask the open-ended question, but also doesn\u2019t want to risk his credibility with the jury.<\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The witness can turn up the heat a little more.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>\u201cThat statement is only partly true. <span style=\"mso-spacerun: yes;\">\u00a0<\/span>I\u2019d like to explain to the jury if I may.\u201d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Almost sickeningly polite, you might say, but effective.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>How can opposing counsel resist?<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Sooner or later, the witness is going to be given permission to explain his point in cross-exam, often by the judge.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>In the alternative, friendly counsel has been taking notes and offers the witness full reign during re-direct, reminding the jury along the way of all the failed attempts by the witness to get opposing counsel to allow the testimony.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Either way the witness wins.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">Of all the techniques taught to expert witnesses regarding cross-examination, I have found this simple recommendation to be the most powerful.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It requires discipline, careful listening and patience, but the rewards are worth it.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The witness is kept out of argument and the offensive potential is considerable.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>In effect, it creates that rare open-ice situation that allows the goalie to score points.<\/p>\n<p class=\"MsoNormal\"><strong style=\"mso-bidi-font-weight: normal;\">Don\u2019t Be Yourself<\/strong><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>I close this article, and this series, with a final admonition.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It stems from a pet peeve of mine, born of experience.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>After hours of training witnesses in the principles laid out in this series, I have often heard a client close the session by telling the witness, \u201cjust be yourself,\u201d thereby undermining the training itself.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: .5in;\">No!<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Do not be \u201cyourself,\u201d if by that you mean communicating as you would in everyday life.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>The trial examination is a communications process unlike any other.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>As with many other communications environments, there are rules and there are effective techniques, and we comply with them when we are in those environments.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>We would say that is true of communicating with children.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>We who are married know it is true in heated disputes with spouses.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>We don\u2019t always comply with the rules, but we usually know when we break them.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It is true in church.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It is true in business meetings.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It is true in courtships (Let\u2019s face it.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>If we were \u201courselves\u201d during courtship, far fewer marriages would result).<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It is true in countless other realms. <span style=\"mso-spacerun: yes;\">\u00a0<\/span>If being yourself was enough to make a witness\u2019s experience a successful one, there would be no need for the prep session in the first place.<\/p>\n<p class=\"MsoNormal\">For more on <strong
