Case Analysis

This service is often used in lieu of surrogate jury research. The case is analyzed from documents supplied by and interviews with the client.

Case Analysis results in a report to the client that includes the following elements:

  1. Case strengths and weaknesses
  2. Case strategy; including themes and recommendations
  3. Graphic recommendations

The analysis is written with an eye toward how the consultant believes jurors would react to the facts, based on the consultant's experience with surrogate jury research and post trial interviews with actual jurors. The report, with its case themes, is often used by clients as the bases for the opening statement and witness examination strategy.

Typically, the documents used to analyze the case include the moving papers, such as the complaint, summary judgment motions and responses. It may also include affidavits, depositions and exhibits.

Opening Statement Consultation and Preparation

Surrogate jury research has confirmed what many trial attorneys already knew, that opening statements are the single most import communication element in most trials. Statistics show an 80% correlation between verdict preferences taken after opening statements and closing arguments.

Opening Statement Consultation is used by clients to aid in the drafting of the most powerful statement possible. This service deals with the structure and language of the opening.

Opening Statement Preparation sessions are designed to maximize the impact of this critical communication element. With the aid of videotaping, the trial attorney's performance is critiqued both in terms of content and style.

Witness Preparation Sessions

These sessions are used to prepare witnesses for deposition and trial. Specific techniques have been developed that train the witness to comply with the needs of friendly counsel in direct examination and to withstand rigorous cross examination.

Witness Video Critiques

When witness testimony has been videotaped, those tapes can be used by the consultant to critique the witness. This service results in a detailed report on the performance of the witness and a forecast of possible juror reactions. The report will also include prescriptive recommendations for improvements.
